The current administration has applied the Alien Enemies Act of 1798 to deportations of aliens. Is this law constitutional, and if it is, can it be legally used as a basis for such deportations? The US Supreme Court has had opportunity twice to look into this question, but has sidestepped it.
The current administration is considering suspending habeas corpus. Would this be constitutional? Are the administration’s attacks against lawyers and judges constitutional? Is a recent executive order ending birthright citizenship constitutional? The US Supreme Court heard oral arguments this week on this and related issues. How will they decide—or will they sidestep this important issue as well?
